Terms and Conditions – Lodge De Groene Specht

Article 1 – Definitions
- Landlord: Lodge De Groene Specht, manager and owner of the holiday home.
- Tenant: The person who makes a reservation and thereby enters into the agreement.
- Guests / fellow holidaymakers: All persons staying in the holiday home with or on behalf of the tenant or using the facilities.
- Accommodation: The holiday home “De Groene Specht”.
- Agreement: The rental agreement between tenant and landlord, including these terms.
- Park management: The managers of the holiday park where the accommodation is located.
Article 2 – Applicability and Formation
- These terms apply to all reservations, rental agreements, and stays in the accommodation.
- An agreement is concluded as soon as the reservation is confirmed by the landlord.
- The terms also apply to all guests and fellow holidaymakers accompanying the tenant.
- The landlord may change the terms; the version at the time of booking applies.
- If any provision is invalid, the remaining provisions remain fully in effect.
Article 3 – Offer
- Prices, photos, and descriptions are presented as accurately as possible, but small deviations may occur. No rights can be derived from images.
- Obvious errors or price discrepancies in the offer are not binding on the landlord.
- The tenant must be at least 21 years old.
Article 4 – Rates and Costs
- The tenant pays the price as shown at the time of booking.
- Price increases due to government measures (such as VAT, energy charges, or tourist tax) may be passed on.
- Discounts cannot be combined unless expressly stated otherwise.
Article 5 – Payment
- At the time of booking, the tenant must make a deposit as stated on the invoice.
- The remaining amount must be paid no later than 8 weeks before arrival.
- Late payment incurs statutory interest and full extrajudicial collection costs.
Article 6 – Information Provided by the Tenant
- The tenant must provide all requested information accurately and on time.
- Damage caused by incorrect or incomplete information is the responsibility of the tenant.
Article 7 – House Rules
- Smoking in the accommodation is not allowed.
- Pets are not allowed.
- No noise disturbances between 22:00 and 08:00.
- Parties, events, and commercial activities are not permitted.
- It is forbidden to use the electrical installation for charging electric vehicles.
- Drug use, aggressive behavior, or otherwise undesirable behavior is prohibited.
- Visitors must be reported in advance and are only allowed between 08:00 and 22:00.
- Park rules remain fully applicable.
- In case of serious violations, the tenant can be removed immediately without refund.
Article 8 – Cancellation and Changes
Cancellations must be made in writing (by email). The following conditions apply:
- If you unexpectedly need to cancel, you can do so free of charge up to 7 days before arrival.
- If the cancellation takes place 7 days or less before the arrival date, we will charge 100% of the total travel amount.
- No-show counts as cancellation with 100% charge.
- Changes are only possible with written approval of the landlord.
- The reservation may only be transferred to third parties with the landlord's consent.
Article 9 – Force Majeure
- In circumstances beyond the landlord's control (e.g., storm damage, fire, illness, technical failures, government measures), the landlord may suspend or terminate the agreement.
- The tenant is entitled to rebooking or proportional refund, but no additional compensation.
Article 10 – Access to the Accommodation
- The landlord reserves the right to enter the accommodation for maintenance, emergencies, or inspection.
- If possible, the tenant will be informed in advance.
Article 11 – Liability
- The tenant is liable for all damage to the accommodation and inventory occurring during the stay.
- All guests are jointly and severally liable.
- The landlord is not liable for loss, theft, accidents, or damage to the tenant’s property.
- The landlord is not liable for failures of utilities or digital communication.
Article 12 – Intellectual Property
- All photos, texts, and materials on the website and in the accommodation are the property of the landlord.
- Commercial use of photos or videos of the accommodation is only allowed with written permission.
Article 13 – Complaints
- Complaints during the stay must be reported immediately so that the landlord can resolve them.
- Other complaints must be submitted in writing within 14 days after departure.
Article 14 – Applicable Law
- All agreements are governed exclusively by Dutch law.
- Disputes are submitted to the court in the district where the landlord is established.
